One of the humiliations confronting the Biden Justice Department in its last days and New York Attorney General Letitia James is how to handle the manufactured criminal cases they are pushing against President Trump. The federal issue seems to have been solved Tuesday. Not only were the charges obviously bogus and brought by an arguably unconstitutionally appointed prosecutor, but the Department of Justice's policy is that it will not prosecute a sitting president.

A tougher case is the New York State civil case brought by Letitia James and the fraud prosecution by Manhattan District Attorney Alvin Bragg in which Trump has been convicted and awaits sentencing; see BREAKING: Judge Delays Donald Trump's Manhattan Case Sentencing Until After Election. This case is more difficult because the DOJ can't order a state to stop its prosecution of a president, though that would be uncharted waters; see What’s Next in Trump’s N.Y. Even though that latter prosecution is at the local level, under New York law, the Attorney General has the authority to take over the case.

used an interview on "The Benny Show" podcast to lay down the law to James and her flying monkeys.

Let me just say this to Big Tish James, the New York Attorney General; I dare you,  I dare you to try to continue your lawfare against President Trump in his second term because, listen here, sweetheart, we're not messing around this time, and we will put your fat ass in prison for conspiracy against rights. I promise you that, so think long and hard before you want to violate President Trump's constitutional rights or any other American's constitutional rights. It's not going to happen again.

Mike Davis has a well-earned reputation as a take-no-prisoners attorney who has successfully fought off the lawfare targeting Trump. A recent Politico article traced his transition, in the words of Steve Bannon:

“Mike Davis was a standard-stock Republican, Federalist Society lawyer, right? Standard stuff. Played by the rules. Helped get guys confirmed, could play tough, but painted inside the lines,” Bannon told me.

Odds are that James will back down, as she's playing a very weak hand against overwhelming power. Still, it is refreshing to see that this incoming Trump team is not cowed by political opposition. Davis is rumored to be the front-runner for Attorney General. Whether this interview helps or hurts his case is unclear, but I hope it helps him.
